Terms and conditions.
The following information is extremely important and could have financial and legal implications if ignored. Dolphin Safari cannot be held responsible for any clients who disregard information, specifically that relating to visas and cancellations. Should you be unclear on any points, please contact us immediately.
Booking
When you confirm a booking verbally or otherwise, it immediately becomes subject to the relevant Terms & Conditions and by confirming your booking you agree to be bound by them. You should ensure you are fully aware of them as they form the basis of your contract with us. The Terms & Conditions are often legally binding and non negotiable and as such, Dolphin Safari strongly recommends you read them thoroughly. It is essential that you read it carefully and check that all the passenger details, arrangements and other details are correct. Unless you contact us within 48 hours from the day of your reservation, we will assume that you have accepted the information therein as correct. Please note that an administration fee may be applied for any changes made after this period.
Price and Payment
When confirming a booking, you will be asked to pay the full amount or a deposit, which is usually non refundable. If paying a deposit only , your balance due date will be shown on your confirmation invoice. Should you fail to settle your account by the due date shown, we reserve the right to cancel your booking at Loss of Deposit. It is your responsibility to ensure your balance is paid on time. Failure to do so may result in charges being applied by Dolphin Safari for which you will be liable. When paying your balance separately to the deposit, a 2.9% handling charge will be applied if paying with a credit card. This is necessary to cover the additional costs incurred by us to accept these payments. Any discounts offered by Dolphin Safari will be applied only at our discretion. No refunds can be made on any ticket supplied.
Surcharge and Price revision
It is occasionally necessary to issue surcharges for fuel, taxes and exchange rate fluctuations. Any surcharges will be passed on to the client. In addition Dolphin Safari reserves the right to revise prices upwards or downwards as may be necessary from time to time. Should the revision constitute a significant change (usually an increase above 10%) then the client will be give the option to withdraw from the contract without loss. Any price revision will be conducted within the applicable regulations and issued with a full explanation. Occasionally Dolphin Safari reduce prices for sales and marketing reasons. While Dolphin Safari sometimes is willing to offer these revised prices to existing clients, we are not obliged to do so and reserve the right to maintain the price you agree at the time of booking.
Cancellation and amendments by the client
If you wish to cancel a booking there will be an automatic 10% cancellation charge. If you cancel your reservation within 24 hour period of your sailing there will be an automatic 100% cancellation charge. Cancellation and amendment fees are non negotiable and can be as high as 100% depending on when you make the change. We will always make you aware of any charges applied. Any request to cancel a booking must be made in writing no later than 24 hours prior to sailing in the case of bookings or groups of less than 10 passengers and in the case of groups of 10 passengers or more one weeks notice to cancel is required. Dolphin Safari does not generally apply an administration charge for cancellations or alterations but reserves the right to do so at our discretion.
Cancellations and amendments by Dolphin Safari
In the event that your dolphin trip is cancelled or amended by us, the compensation or refunds offered may differ greatly. However, should any excursions have to be abandoned through force majeure, weather or difficulties the best possible refund will be arranged according to circumstances. Dolphin Safari will assist you in the unlikely event of cancellation. We will ensure that any refunds due back to you are made without delay using the same way used to book your excursions, (credit cards will have a fee of 2.9% surcharge) Dolphin Safari reserves the right to change the time of sailing or to move you on to a more convenient sailing by 30 minutes either way.
Withdrawal of tours
Dolphin Safari reserves the right to withdraw any excursion through lack of demand and to make any alterations that they deem advisable for the comfort of the passengers, bearing in mind the convenience and best interest of each group or family.
Insurance
Dolphin Safari takes passenger safety very seriously and has full public liability insurance along with all necessary documents, licenses, certificates and equipment required to operate a safe, comfortable service for our customers.
Passports and Visas
It is your responsibility to ensure that your passport is valid for travel and that you have obtained any visas that may be required for your visit to Gibraltar Dolphin Safari cannot accept any responsibility if you are unable to travel into Gibraltar because you have not complied with any passport, visa or immigration requirements. If your passport is due to expire less than 6 months from the return date or your holiday in Gibraltar, you will be required to renew it and provide updated details before you travel. Gibraltar have strict requirements and it is your responsibility to comply with them. Please call the Gibraltar office of Tourism on (00350 200 43635) if you are unsure of any entry or visas requirements, however, as these requirements can change at short notice, we cannot offer any guarantees as to the reliability of any information provided.
Health
You must make us aware of any existing medical condition that could require special consideration, prior to confirming your booking. Any requests for mobility assistance will be considered individually and provided at our discretion.
Complaints
We will always strive to provide you with the highest level of service however, if you need to make a complaint against the services offered to you by our company, please do so in writing and mark it for the attention of Customer Services. We will acknowledge your letter immediately and let you know when to expect a full reply or contact from one of our senior staff.
Privacy and data protection
Any information we receive from you will be kept private and will only be passes on to third parties where you have agreed to the information being used in this way.
Personal possessions
Coats, wraps, umbrellas, cameras, handbags, travelling bags, shopping bags and similar personal articles remain at all times through the tour under the passengers custody and control. Be careful that you do not leave your possessions unattended at any time in the office or Dolphin Safari boat.
Ecology and Environment
It is our policy to maintain a positive and proactive position in relation to the environment. We realise that there is much to be done to achieve our company goals. To this end we are continually striving to increase awareness of any environmental issues that are likely to affect any of the tours we offer. We ask that you support us in our efforts by respecting the environment of the dolphins.
